IVE FISHED WITH HIM THE LAST 8 YEARS AND CONSISTINTLY CAUGHT TUNA SHARK SWORDYS ALL LET GO EXCEPT ONE CAUGHT LAST YEAR ABOUT 154 LBS OF WHICH HE TOLD HIS CLUB HE CAUGHT SINGLE HANDEDLY<NO PROBLEM WITH THAT LIE> BUT MY QUESTION COMES IN THIS DIRECTION, I NO LONGER FISH WITH HIM BECAUSE HE CLAIMS THAT I OWE HIM 400 DOLLARS FROM A CACTH OF 12 100-125 LBS BLUE FIN TUNA THAT HE CLAIMS TO HAVE A COMM LICESNE FOR OF WHICH I NOW THAT HE DOESNT HAVE.I HAVE CONSISTINTLY CAUGHT TUNA BLE AND YELLOWFIN IN THE RANGES OF 10 TO 35 FISH A TRIP, BUT HE GETS GREEDY WITH EVERY TRIP.I HAVE NO PROBLEM WITH DONATING THE CATCH TO EXPENSES ON THE BOAT,BUT I DONT WANT TO BE TOLD THAT HE ONLY GOT 05 CENTS A POUND AND THAT I OWE HIM 200 DOLLERS.I HAVE DATED PICTURES WITH OVER THE LIMIT CATCHES AND NEED INFORMATION FOR ANY CONTACTS TO END THIS SITUATION OF HIM THEATING ME.I DONT MIND CUTTING BAIT FOR 2 HRS ,HAND LINING FOR 6 HRS BUT DONT WANT ABILL ONE WEEK AFTER WE GET TO DOCK!!! ANY REPLYS WOULD BE GREATLY APPRECIATED.

Edwiss67, I’m not a lawyer here, but IMHO you owe him nothing if you were crewing a vessel that was fishing illegally. This would go beyond having whatever agreements you might, or might not have had with the captain. I believe any and all agreements between parties, regardless if they are written or verbal, to perform illegal activities are null and void and illegal in and of themselves.

Now it seems to me that you were a willing participant to this illegal activity who actively and willfully engaged in this so where exactly that leaves you I’m not too clear. I think we need a lawyer here. In my mind it may be like 2 bank robbers arguing over the loot they got from their last job, but, it may play out differently as I believe NMFS and commercial fishing labor laws, etc. would have some definite opinion on this matter.

I have answered your question to the best of my ability based on what YOU posted, so my recommendation at this point would be to meet with the guy, get into a good argument with him that leads to blows, beat the pulp out of each other, and maybe you both will learn a lesson.

Sounds Familiar

This sounds very familiar.
A charter was on a boat out of Montauk and a party on the boat hooked up with a decent amount of blue fin.

The Capt laid claim to the fish and there was a heated arguement.

Bottom line the Capt kept the fish and the client sued him and the Montauk Capt Assoc. and WON.

Make it clear before you even book the boat who gets the fish.

If you would count the Capt in on the sale for an EQUAL SHARE I don't think that there would be a problem especially if he has the contact for the sale of the fish.

One other point when booking a chrter especially out there.

Not all but a FEW boats will try and put the screws to you.
State the when you are fishing for S/B and limit out that you would like to try fluke or anything else to finish the time of your trip. I have heard that some guys once you finish what you wanted to fish for and have your limit head back to the dock.

BE VERY SPECIFIC IN YOUR DEATILS BEFORE BOOKING!!

Sales of Fish

I once had a friend(?)who had a large Hatteras that he couldn't afford.It was exactly as someone said, "If you can't afford to run your boat,get a smaller one". He was licensed to sell his catch.His greed led to the demise of our freindship.If we were skunked he was an idiot, if we were hot,he was a complete idiot. He would expect us to pay his way on tough days and wouldn't share the catch, even for dinner on good days. These days I have a select group who I fish with.They all have decent, affordable boats. They all have good jobs and can afford to fish for pleasure, not profit.The only stress we feel is self imposed rivalry, not the white nuckle fear of the Bait and Fuel Bill at days end. Leave commercial fishing to those who make their living from the sea.

First of all, drop the caps. Second, I'm still confused. Third, As stated above, you can't contract for illegal activity (ie. you can not be sued for gambling debts or loans by your bookie or loanshark). However, this is not per-se illegal activity, this is fishing, where he or you or all the crew broke the law on occasion. So we are not talking about the illegal activity but a legal contibution to the splitting of expenses. In any event, he can not sue you for expenses and prevail as there is no written contract and he can't prove there was any agreement, written or oral, to contribute. There is also no common "industry practice". I crew on another's boat and the only agreement is he keeps it all minus one loin YFT one loin Albacore and one Mahi per crew member. All BFT out of Hyannis is sold to cover year round expenses. On my boat, we daytrip to the canyon. I fish with two others and I pay fuel, and the minimal ice and bait they bring food and beverage and that most important commodity, the ability to work (as I cant and wont go offshore trolling 8 rods alone). Every boat is different. Finally, I agree, he sounnds like an *ssh*le, but dont become a rat to get even as you too could end up getting burned. Just find another boat to crew on. P.S. I am a lawyer, I dont do contracts but I'm very sure I'm correct. As to ratting and opening a can of worms, I specialize in criminal defense and on that I'm %100 positive.

We should take up a collection on this board for the $200 bucks. With the only stipulation is everytime you go fishing with this "captain" you let us know! This way you can go fishing with your friend and we can have the DEC at the dock so your friend can get whats coming to him! Let's not LOSE FOCUS here, whats more important going fishing or rapeing a resourse WE all love to do!!!!

Between the Goverment doing a poor job in the fisheries department and the commericals getting more and more of the stocks. ALL fishing is only going to get worse! When I hear Recreational "fisherman" doing stuff like that it gives us all a bad name.

I don't know where you guy's fish, but where I fish Taking of undersized fish or OVER YOUR BAG LIMIT is DEFINITLY ILLEGAL! ( maynot be as bad as some other things!)

I'm not a lawyer nor a preist. Just a father and a fisherman who hope's there will be some fishing around when my children get older. But if you fish illegally your a MUTT in my book! ( I had someother choice words but I know B.Attitude would edit them out anyway)

Like the other I'm more than a little confused by your post. But even if the guy has a general category license, which allows him to sell tuna, the sale of 100-200lb Bluefins is illegal. Whether or not over the (recreational)limit catches are legal or not would depend on the fishing license he has. For example, if he has a NY state license and a NMFS license he can keep a lot more that the recreational limit on lots of fish.

comes to see you, you bring them to see "your friend", the two of you "hopefully" either get locked up or have your vessel(s) taken away and
the rest of us can feel better that you two no longer have the means to continue

Expenses for running the boat and what happens to boated fish should be all worked out before you even go. There should be no surprises, especially after 8 years of it with the same capt and crew.

What is the real problem here and what is your point bad-mouthing someone on the internet? Sounds like you had differences you couldn't work out and you lost your ride. Work out your personal problems off-line, yes? And maybe buy your own offshore machine and do it the 'right way' and you will be happy.
