Bad/flawed collection of data is killing the NY recreational guys. The Fluke situation is atrocious. Writing letters doesn't help. Attending meetings and expressing opinions/beliefs/ideas doesn't help. Hiring lawyers doesn't help. So whats left?

Stop reporting your catch. There is no law that says you have to. Don't let them know what you have caught. Pass the word to all your friends. Have them tell all their friends. Spread this word at the docks, the marinas, the yacht clubs, the party boats, charter boats and fishing clubs.

Been out of the loop for awhile ..... thanks for pointing out that to me invincible. Found it spelled out here:

http://www.dec.ny.gov/press/12363.html

"Marine Party and Charter Boat Observers- all holders of NY Party and Charter Licenses are now required to carry an on-board observer and to report catch and effort information when requested to do so by the DEC or National Marine Fisheries Service (NMFS). "

I can't believe its come to this ...... the DEC makes you pay for a permit to do business, then requires you by law to report the very data they will use to virtually put you out of business. Wow ....

That taken into consideration, I still want to stick by my original suggestion. I don't see any other choices.

Captpaul, my logic was based on NY's history of supposedly exceeding their allotment. If it wasn't exceeded last year and years before then there wouldn't be the current crisis.

Interesting.

Without breaking laws (meaning following all bag and size limits), I totally agree, in theory, with not reporting any catches. Someone asks me how many fluke I kept last year... my answer is 0. Stripers? 0. Sea Bass? 0.

I like it...

The damage has already been done.

They have already made the allocations based on years of errant data. We complain that the data is bad. So, if they ever do get good at collecting it, we may stand a chance at having things adjusted. But if there is no new data, especially from uncooperative fishermen, then they will simply fabricate their data sets from the very little data they collect- They will always be able to collect something.

The thing that got us where we are, is that small samples of data were extrapled to get the big numbers. By giving them smaller sets of data to work w/, they will either come up w/ worse numbers, or simply throw them out and use an old data set and chart to estimate landings.

Simply, by eliminating the chance for newer, better data, we are certain to be locked in where we are.

As to the for-hire sector legally being required to report landings, that bis a law, but it is only a law to enforce the second part of the set- To require the allowance of on-board observers. The state is reserving the right to require the VTRs, not excercising it. At this time, the only vessels required to submit VTRs to the stata are those w/ federal permits. If we were required to submit VTRs across the board, and they were used to estimate landings, things would not be as bad as they are now. At this time, the for-hire sector's landings are still determined by the parking-lot-Ouji-Board Teams, and the on-board coffee-clutch group.
