Further to an earlier thread about enforcement powers of, or abuse by, the DEC, Newsday reported that DEC officers made a DWI arrest of a truck driver on Sunrise Highway this week.
DEC Reg. Dir. Peter Scuuly said officers have the training and authority "to inforce any of NY State's laws". Hmmm.

WELL I THINK THEY DO A GOOD JOB BUT COULD BE MORE UNDERSTANDING
TWO YEARS AGO I CAUGHT A STRIPER THAT WAS LESS THAN A HALF INCH SHORT SO I WAS GIVEN A SUMMONS AND THE OFFICER WENT ON HIS WAY BUT ABOUT 10 MINS LATER HE COMES BACK WITH HIS GUN DRAWN AND ORDERS ME TO GET ON THE FLOOR AND ALMOST GAVE MY WIFE A HEART ATTACK HE ORDERED ME TO LAY DOWN ON THE FLOOR AND THEN HE PLACED ME IN CUFFS TELLING ME I HAD A WARRART AND HE WAS GOING TO DETAIN ME UNTIL THE POLICE CAME WELL THE POLICE CAME AND SAID I HAD A WARRANT FOR SOMETHING THAT HAPPENED IN 1997 WELL I ENDED UP SITTING ON RIKERS ISLAND FOR 1 AND A HALF MONTHS UNTIL I SEEN A JUDGE WHO THEN SAID WHAT THE **** AM I DOING IN HER COURT ROOM FOR A WARRANT THAT WAS SO LONG AGO IT TURN OUT I HAD THE WARRANT FOR A OPEN CONTAINER
THE THING THAT REALLY KILLED ME WAS THE NEXT DAY HE CAUGHT A FISHERMAN WITH 2 FISH THAT WERE 17 AND 19 INCHES AND LET THE GUY GO
AND WHEN I WENT TO COURT FOR THE FISH SUMMONS THEY CAUGHT A GUY WITH 88 PORGIES AND FINED HIM $250 FOR EACH FISH

Good for them, one less drunk on the road who can kill innocent people.

If you are going to keep short fish , you get what you deserve.

A couple of years ago when I lived in California, I was driving, cops were running plates and mine came up as stolen, they pulled me over at gunpoint. Turned out it was a mistake, but at first they did not know that so they took precautions they needed to protect themselves. didnt bother me one bit , they did what they had to do.

How do you know what he did the next day if you are sitting in Rikers? If your story is true, you should see an attorney - you might have a decent unlawful imprisonment lawsuit. I never heard of anyone doing time for an unpaid summons.

Riker's is a prison. The inmates there have already seen a judge, been tried, sentenced, and convicted. You do not sit on Riker's waiting to see a judge for one day, let alone a month.

You also don't go to Riker's for having a warrant for an outstanding "C" summons. You go to Community Court and settle the summons.

Riker's is not a prison it is made of up ten diferent County jails for all five buroughs..It holds inmates that are sentenced upto a year or less as well as people who can not post bail after being arraigned..When Suffolk and Nassau jails overflow they are also sent to Riker's Island. JC I am not taking a stab at you just telling you the facts.
..As far as someone being held for a month and a half before seeing a judge, have a hard time believing that...

I wouldn't really complain about being harrassed. You did keep a short fish after all. Whatever the story is after that, that should not be discounted. What he did for the other two guys the next day (weren't you in jail?) doesn't really matter. I hope you learned your lesson. With all this regulation talk I don't see why anyone would take a fish even a half inch short. Just like women there are plenty of other 28"+ fish in the sea.

Yes, like you said, it is a prison, for holding people SENTENCED for 1 year or less,the definition of a misdemeanor in NYS. People waiting to see a judge cannot already have been sentenced to a prison/jail term. In NYC , you are taken to a central booking facility, those are in each boro.And I'll say it again, you most certainly do not go to Riker's for not answering a "C" summons, which is a Criminal Court summons, issued for things like open containers of alcohol in public, disorderly conduct, public urination, ect.
What really made me respond to this post was the whole "gun in my neck" line. That is such an outlandish statement, but of course, if you challenge someone on it, you'll be met with a " don't tell me what I saw" line. ANY trained law enforecment professional ( and NYSDEC officers are well trained) would never dream of getting so close to a person so that they can touch the subject with their firearm, in a situation where you are drawing your weapon. That's just poor tactics, any rookie will tell you that!

eskew , no problem at all, I don't think you were taking a stab at me! But if you were, it's all good, I've had much worse, and in real life, not over the internet :). Were you taking issue with my use of "prison" as opposed to "jail"? Ok, agreed on that, prison, by definition, is for long term sentences.

You had a warrant out for not responding to the summons for the open container. Had you responded to the original offense you would not have spent 6 weeks in jail. Also if you had hired a laywer instead of a legal aid you would not have spent 6 weeks in jail.

Lesson learned?

maybe it is different in NY but in MA you are not given a legal aid (court appointed attorney) because the max sentence is a fine and maybe 10 days. It is a misdemeanor and you would have to get your own attorney or represent yourself.

if everything that he said happened i would bet that he was not a good boy earlier in life and had other offenses that made the PO approach with his firearm drawn. In twenty years i have never put a firearm in contact with a persons body. as stated that is rule #1.

in rikers for a month and half sounds fishy also. a misdemeanor warrant for open container would have been released for someone with something more serious. (unless the overcrowding is not a problem as it is in most jails/prisons)and not seeing a judge is not kosher either. he states that it was a summons, so once arrested you would see the judge and be arraigned on the summons and a date set for compliance and election, pretrial, or motions. again if held he has a history of being a bad boy or no shows for court and he was held for that reason. (again unlikely as it is a misdemeanor).

again this is MA and maybe it is different in NY and maybe the terminology is different also.
