The current regulations describe an open season. The emergency rule passed by totally uneducated persons in August closed the 2007 season on Sept. 17th, but made no mention of an indefinite closure, or the alteration or negation of the standing rules.

So, I say, KEEPER!

That's kind of what I was thinking, the closure technically ended on 12/31/07 at midnight, so we are now in the 2008 season, which is open season until we see new regs. I say keeper also, wonder what DEC says?

Right now, I'm confident enough in my reading comprehension. But I'm more confident that the DEC will pass another emergency rule effecting the 2008 regs long before the fluke get in under 25 fathoms in any significant numbers.
