Hello all,

With the new regulations out for fluke this year I got to thinking. I realize the regs say no possession allowed, but can I fish catch and release? I really just enjoy the pursuit, not so much concerned with keeping my catch. Is this legit? Or could I be fined for C&R?

How about if you just drifting bucktails w/ a squid strip. No meat just a bucktail squid combo and you get fluke. Can't you say your going for Stripers as this is a common way to go for them. The DEC has no way of proving we are targeting a specific fish I could show them 5 fishing books that says bucktail and squid/pork grind combo work for Stripers.

there are fluke all over. Even if you moved to a new location chances are that you would still be on top of fluke.
The onus is on us for sure, but you are still likely to pick up fluke while fishing for stripe bass, sea bass, blue and weak fish. The DEC is going to have to show a little consideration. Or is it their way to shut down all fishing once the fluke season ends.

If they ever shut down the fluke season for the year, they should allow us to catch and release, atleast so some people will still fish, and the party boats might be able to get a few people to come out. And so all the other species of fish arent over fished like crasy.

Of coures you have the chance of catching fluke in any part of the ocean. But if the DEC observes you making the same drift 3 or 4 times and catch fluke on every, that excuse will not hold water. You must make an attempt to avoind catching fluke.

Now one long drift is ok. You could say you are not targeting them.

Where in the regs does it cover targeting? I only see possession

I have a fishing buddy in NJ who called the State to inquire on catch and release. He claimed they told him that the violation is possession not catch and release. Can anyone point to the regulation in NY that specifically states targeting a species as against the regs?

If you want to get technical about it, how are you going to release a fish wihout possessing it, even if its just for a moment?

Not in the NY interpretation of possession. That is why there is no targeted fishing permitted after you retain your limit- If you have the possession limit on board, when you reel up a keeper, you are over the possession limit.

what one earth does a cooler have to do with it. Are you not "in possession" of you fishing rod if its not in the cooler? Maybe you don't possess your cash if its not in your wallet?

I have never once seen a DEC member in the ocean.. I'm sure they need to budget state funds when it comes to the price of gas. There is no way they have unlimited funding to zip around the ocean all day. However I see them all the time in the bay and at the ramps.
