DEC Tagging

Mike,

Just don't expect them to do that on a regular basis. That ECO was probably the rookie girl from last year that was doing that for some guys at The Point, but it is not a "official" action. I spoke to her (I think her name was Mindy) and she said she was doing it for guys overnighting, but it was not an official tag. I don't think you would find Joe Billato so accomodating, and they don't have to be.

Seems to me that having a fish ?tagged? as caught on a certain date in an excellent solution to this problem. I can recall a few years back when an angler had two fish over forty-pounds over two of his three day stay in Montauk and was later sited for having 2-fish in his possession. Anglers should have the right to keep their daily limit and such a system would allow it.

I also don?t think DEC would need to be issuing the tags, it could somehow be verified a local bait and tackle shop or marina.

Do you know how they handle anglers keeping their limit on open/charter boats in NY?

I imagine there?s some type of a similar system in place for anglers that fish charter or party boats that are allowed 2-bass per angler, but I?m not sure how they handle it.

Through the grapvine

Two friends of mine fished a boat two seasons ago out of Captree. One of them caught one fish tha was a keeper. They told me that at the end of the night there was so much stiper fillets they were giving them away. The friend of mine who did not catch anything went home w/over 10 lbs of meat.

Neither one of them said anything about reciepts for fish. It seems they were just keeping as many fish as they could unitl it equelled the amount of people on the boat....regardless of who caught them.

Charters are required to keep their receipts showing the fish caught and the charter permit number in order to legally posess two fish.

I had mentioned a tagging program possibly run by tackle shops, where they could tag a fish on a daily basis, but the ECO said that would open the door to way too much forging and funny business (tagging fish in different shops, illegal sales of tags, etc.) In other words, its probably not going to happen.

If they trust the charter boat operator to do the right thing, why not the tackle shop owner? It would be just as easy for a captain to write up a receipt for someone as it would a shop owner to verify when a fish was caught.

Besides, I don?t see too many people going through the trouble of have a fish checked in at a tackle shop unless he?s legit.

It still sounds like something to explore to correct this inequity in the regulation.

The only thing hard to believe about this story is that a Captree boat caught thier limit, that's pretty funny!

Striper Limit

Montauk boats do it the same way. They count the fish caught when it adds up to 2 X # of anglers on thew boat. thats it no more fish are kept, they fillet them up and you walk off with 2 filleted bass and a receipt for 2 fish

I am just relaying what the ECO had to say about the tagging idea. He thought it was a good idea, but a little difficult to enforce and not at all on the radar at this time.

Kevin and Meandtheboyz, I would guess that is a common occurance. Even on private boats. How many times have you gone fishing with your kids or friends who weren't as proficent at catching fish, but it really means a lot to them to bring home fish, so you catch and keep your limit and proceed to help them with theirs (beit one bass each, 10 tog, 6 weaks or however many fluke we're allowed now). I don't think this practice is illegal or immoral. The boat would be allowed to keep that many fish either way. It is still up to the individual angler to catch and release if they choose to. I could be wrong about the legallity of it though, if someone knows otherwise, please point it out in regulation.

Party Boats Suck

The thing that sucks about those party boats...is they will leave early when the boat limits out...

What about the guy who catches nothing??? Sure, he gets to bring two fish home...but what fun is that???
I'd be pissed if I pay $70 for a 6 hour trip and didn't catch anything, then left early because the boat limits out.

I am no expert here, but I think most of the regulations state possession, so it would seem that if you give the fish away, you are no longer in possession. Probably cannot do it once you have kept your limit, because technically you would have to possess the fish before you gave it away and at that point would be in violation, but as long as you stay 1 short of limit I don't think that would be a problem ( but I won't pay your fine if I am wrong ).

My experience with boats out east is that they take the number of people on the boat and keep two fish for each person and then divide up the filets unless any one person asks to keep his own fish, and then they oblige. This is however not really legal, as they always count the crew and that is not permitted. Only customers can keep two fish, crew can keep none, that was the trade off for the two fish limit. When it was one fish I believe you could count the crew. You must keep your receipt as the DEC often checks on the way home from Orient or Montauk because it is so easy with the limited number or roads.

just bring it back to your car and ice it before midnite,hopefully with a witness,then go back after midnite.the burden of proof is on the law.when questioned,tell them the TRUTH!never had a problem when i told the truth and was polite.

Hi guys here is a question I can help with. On the bass trips I have taken on the viking out of montock they keep a running count as the fish are landed when & if tjhe limmit is reached they head home. They do not really keep track of who has what in there bag. But if you give them more than two fish to clean they would have a problem with it. Would ask you to give the extra to some one who has not limmited out. I have always limited out. I am trying to teah my son to be a responsable fisherman We make sure the size and quantity is right. He baged a stripper last year that was right at 28'' I asked if he wanted to let it get bigger. He said he would catch him latter. I was proud of him.
