Official Tournament Rules and Regulations |
OVERVIEW
1. Fluke Mania Tournament Prize Money is as follows:
a. $10,000 First Place; $2,500 Second Place; $1,000 Third Place; $500 Fourth through Tenth Place
b. $1,000 NY Port Prize; $1,000 NJ Port Prize; $1,000 CT Port Prize; $1,000 RI Port Prize
c. First Place winner can only win $10,000 first place prize. All other winners are eligible to win their place prize and port prize.
d. Port prize eligibility is determined by the state in which the angler submits their registration. Anglers registering online must choose their port before submitting registration. Designated ports can not be changed after submitting a registration. Fish must be weighed in at a weigh station within the chosen port.
2. Anglers are competing for the highest weight of one fluke. Fish must be a minimum of 20.5-inches in order to be eligible for weigh-in.
4. Anglers must depart from a New York, New Jersey, Connecticut, Rhode Island, or Massachusetts port or fish from shore or pier in those states. The tournament runs from 7:00 AM on July 12 through 6:00 PM on July 13, 2008.
5. Any angler eligible for a prize is subject to take a polygraph test and must sign a release document. Anglers subject to take a polygraph test must take and pass the polygraph test within two weeks of the last day of the tournament. Anglers subject to take a polygraph test will be alerted that they must schedule a polygraph. If angler fails to schedule and pass the polygraph test, their prize money will be forfeited.
6. The final day to enter is Sunday July 13. (Same day entry allowed).
ENTRY FEE
Entry fee is $25. If paying by check or credit card, entry is not valid and angler is not eligible for prize until check clears or credit card is processed successfully. Nor'east Media, LLC. offers no guarantee that we will be able to contact angler to inform him/her of their ineligibility for tournament prizes.
WEIGH-IN DETAILS
1. Weigh-in will be held at any one of the selected weigh-in stations.
2. Fish weighed must be a minimum of 20.5-inches
3. All fish must be caught during tournament hours by means of hook and line in accordance with applicable state rules where fish was caught and be presented as fresh, not frozen.
4. Each contestant can only weigh in once.
5. Entry must be complete before angler begins fishing in the competition.
6. Each of the weigh-in stations will be using certified digital scales.
7. Participants must present their registration form to the weigh master along with fish to be weighed between the hours of 7AM through 6 PM on Saturday, July 12 or 7AM through 6PM Sunday, July 13 2008.
8. All fluke presented to the weigh master will be recorded in pounds, tenths of pounds, and hundredths of pounds.
9. The Weigh-In Slip will be signed by the weigh master and will be the document used to resolve any disputes. The angler will also be given a copy of a Weigh-In Slip to sign for confirmation.
10.If two anglers tie by total weight for any of the prizes, the tie breaker will be the longest fish. If there is still a tie, the fish presented at the earlier time of day (on either Saturday or Sunday) will be declared the winner. If there is still a tie, anglers will split the combined prize of the tied positions.
11. The decision of Nor'east Media, LLC. is final in all matters relating to the Tournament. SPONOSOR: Nor'east Media, LLC., 525 West Jericho Turnpike, Smithtown, NY 11787 ("Noreast") Eligibility: The Noreast.com Tournaments, including the Flukemania Tournament ("Tournament") are open to legal residents of the 50 United States or District of Columbia age 18 or older at time of entry. Salaried employees are not eligible to win a tournament prize although they can participate in any tournament.
TOURNAMENT PRIZE ELIGIBILITY
Any angler eligible for a prize based on registration and weigh-in results is subject to undergo and pass a polygraph test to confirm that they caught the fish in accordance with all tournament rules and regulations and s/he was registered for the tournament at the time of catching the fish. The polygraph will be conducted by a testing facility and at a testing site determined at the sole discretion of the Sponsor. The angler will be responsible for scheduling and traveling to the testing facility at their own expense. Anglers subject to a polygraph will be alerted and sent details for scheduling by Nor’east Media. Anglers who are contacted to take a polygraph must take and pass the scheduled polygraph test within two weeks of the last day of the tournament. Failure of the angler to schedule and pass the test within the time constraint will result in forfeiture of prize money. In the event of any dispute pertaining to a failed polygraph test, the only recourse provided to an angler will be to take a second polygraph test at the polygraph testing facility designated by Sponsor at the angler's own cost within one week of receiving notice of his or her failure to pass the test provided by Sponsor. Anyone who does not pass the polygraph test will be disqualified and not be awarded a prize. The results of the second polygraph test, if applicable, will be determinative of whether an angler qualifies as a winner. Potential winners will be notified by telephone, and/or mail within 30 days of the Tournament and will be required to sign an Affidavit of Eligibility and Release within 10 days or will be disqualified. Prizes will not be awarded until 60 days after all potential winners have been verified. Winners will receive an IRS Form 1099 for the value of the prize.
GENERAL TOURNAMENT RULES
The tournament will be held rain or shine. It is the sole responsibility of the captain of all registered anglers/boats to determine if weather and sea conditions are safe to fish. By participating you acknowledge that you could experience certain hazards and be involved in certain risks and any time during any Tournament you may elect not to participate if you think weather or any other hazards are too great. Sponsor and those associated with Tournament and/or any boat owners and crews assume no responsibility/liability for boats entered or individuals participating in the Tournament. You agree to indemnify and hold Sponsor harmless for all claims and costs, including attorney fees, arising out of your conduct/participation in the Tournament. If for any reason the Tournament is not capable of being executed as planned for any reason, Sponsor reserves the right in its sole discretion to cancel, modify or suspend the Tournament. Entrants who do not comply with these Official Rules, or interfere with the Tournament, in any way in Sponsor's sole discretion shall be disqualified.
GENERAL PROVISIONS GOVERNING TOURNAMENT
Acceptance of prize constitutes permission (except where prohibited by law) to use winner's name, prize won, voice, hometown and likeness for purposes of advertising, trade, promotion and publicity without additional compensation. You agree to comply with the Official Rules and the decisions of Sponsor, which will be final/binding in all respects. By participating you agree to release, hold harmless and forever discharge Sponsor, and all associated with Tournament, and their respective parent companies, affiliates, subsidiaries, and their respective officers, directors, shareholders and employees (collectively, "Releasees") from any claims for damage, loss or injury to property, personal injury or death; libel or slander, incorrect or inaccurate transcription of entry information, or for any human or other error, technical malfunctions, omission, interruption, defect or any other error, or any injury or damage to participant or any other person or any person's personal property used by the participant resulting from participation in the Tournament, or arising from any Tournament related activity or from the acceptance or use of any prize won. The Official Rules are governed by and shall be construed in accordance with the laws of the State of New York without regards to its principles of conflicts of law and you agree to personal jurisdiction by the courts located in New York County, New York, and waive any jurisdictional, venue or inconvenient forum objections to such courts. Further, in any dispute pertaining in any way to the Tournament, your sole remedy will be to recover your entry fee(s) paid.
