Just read the Miss Montauk fishing report and Capt Jamie indicates that he waill be sailing next sunday 11/8 for cod and seabass and that he has a seabass permit. What is a seabass permit. He should be sailing in federal waters and the seabass season ended on 10/5. Can he legally catch seabass?

yea i dont fully understand this either, some captree boats on their site are saying they are going for seabass, but maybe it isn't updated?
i started another thread if anyone knows anyone else sailing for sea bass.

The shut down is federal I believe, so Seabass still open in state waters i.e. >3 miles from shore. Some of the PB's have given up their fed permit so they can venture father for seabass. Someone can correec me if Im wrong. Look under the 'Fisheries Management' board.

our response makes sense about about catching seabass in state waters, but the comment was about catching cod also. Dont know anyone catching cod in state waters ( 3 miles). Love cod fishing and would like to know where you think they are catching cod 3 miles from shore. They did this over a hundred years ago, but in my lifetime.

I've seen another LI boat advertising sea bass and porgy trips under an RSA permit. I'm not sure if they're a sponsor so I won't link to them. The RSA program is a set-aside of 3% of the quota to fund research efforts and participants are typically allowed to land fish under the program during closures. I haven't been able to find any confirmation that there's an active program for black sea bass, but this is the most likely scenario.

I don't think you CAN get Cod that close to shore. However, I know that in Mass, Montauk, and Rhode Island, it doesn't take nearly as long to get out to the Cod grounds. I was exchanging private messages with Captain Chris of the Island Current, and that's why the new boat is going out from Rhode Island; not the Bronx, in January. From RI it's only an hour to the Cod Grounds. From City Island it's basically impossible.

I didn't know about that loophole in the law. So, let me get this straight, if a boat gives up its federal permit, then it CAN fish for seabass past 3 miles?!?! I'm just a little confused.

Fishead you need to get your information correctly. I have fished for cod in Hampton Beach, NH and most of the action is well over 2 hours, same for Walsh's in boston. I fish regularly on the Frances fleet out of Pt. Judith RI and it takes them better than two hours to get to the cod grounds, at least for the 3 trips I have made in the last 2 months. Dont know where the other boats from RI are fishing, but the cod grounds on Coxes Ledge will definitely take them more than 2 hours. There have been a few Montauk charter boats and some private boats out there.

It's not really a loophole. If a boat has a federal permit that specifically lists a species for which a federal moratorium has been put in place, then that boat cannot take that species from state waters either. That's apparently a matter of how the federal permits are worded. Most boats have surrendered their federal sea bass permits so that they can legally take sea bass from state waters (within 3 mi).

If there is an active sea bass RSA program, then participating boats would be allowed to take sea bass from federal waters. These boats would in effect be buying a weight quota of fish that they would be allowed to take during the closure and when that was met they would be done. I have not seen a NOAA publication to indicate that there is an RSA program in place during this closure, but the boats advertising offshore sea bass fishing suggest that there is.

Will they fish for cod/sea-bass in state water off Block Island? Seen Viking Block Island porgy trip reports said they been catching some cod, just not the great number that Frances is doing at Cox(?). Caught one cod myself last year on those deep-water porgy trip, maybe a total of 10 cod for a full railed boat.

Capt Lou is doing the 20 miles and 60 miles offshore trips with their RSA permit.

Without an RSA permit it would be illegal to possess black sea bass in federal waters. Regardless of home port, you need to cross the 3 mi line to get to Block: http://www.charts.noaa.gov/OnLineViewer/13205.shtml An RSA boat would probably have to account for such a catch under their RSA quota despite having taken them in state waters.

seabass shutdown

This whole thing really burns me.Emergency shut down unless you have some cash then its ok to fish. ITs either the fish stock is in trouble and of need of rebuild or it is not..Our Gov. is so corrupt it makes me sick and also makes me want to become a pirate and do whatever i want. Fillet and release seemes to be option. I guess the writing is on the wall. It will be pay to play on most types of game fish, so sad because i hate golf...Buy two licenses by jan. but you cant catch flounder, probably one fluke at 23in on every other tuesday, they will shut down bass unless you fish during a leep year, im sorry im going on and on but i smell a rat....

If I remember correctly, emergency shut-down is only on recreational, not commercial, so go figure who decimates sea-bass, the weekend guys only go out couples times the entire winter? or the others who goes out whenever weather permits?
